1. Who you are contracting with

These Terms govern your use of practisEN (the “Service”), provided by husain alsulmi (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms.

2. The Service

practisEN provides AI-assisted TOEFL Speaking practice, scoring, and feedback. We may update, improve, or change features at any time.

3. Eligibility and account

You must be of legal age in your country to enter a contract, or have permission from a parent or guardian. You are responsible for keeping your credentials confidential and for all activity under your account. Provide accurate information and keep it up to date.

4. Acceptable use

You agree not to:

  • Use the Service unlawfully or for fraud, spam, or harassment.
  • Infringe intellectual property or privacy rights of others.
  • Interfere with security (malware, probing, scanning, scraping, rate-limit evasion).
  • Reverse engineer, resell, or redistribute the Service.
  • Circumvent technical limits, plan limits, or access controls.

5. Intellectual property

We retain all rights in the Service, including software, models, prompts, content, documentation, and branding. You are granted a limited, non-exclusive, non-transferable right to use the Service within your subscribed plan.

You retain ownership of content you submit (e.g. recordings, responses) and grant us a limited licence to host, process, and analyse that content solely to provide and improve the Service.

6. Payments and subscriptions — Paddle as Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Billing, taxes, renewals, cancellations, and refunds are governed by Paddle’s Checkout / Buyer Terms. Subscriptions renew automatically until cancelled. You can manage your subscription via paddle.net.

See our Refund Policy. We offer a 30-day money-back guarantee, processed by Paddle.

8. Service availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. Maintenance, updates, or third-party outages may cause temporary interruptions.

9. AI outputs and accuracy

Scores, feedback, and other AI-generated outputs are provided for practice purposes and may contain errors. They are not a guarantee of any official TOEFL score or outcome. You are responsible for how you use outputs.

10. Suspension and termination

We may suspend or terminate your access for:

  • Material breach of these Terms.
  • Non-payment.
  • Security or fraud risk.
  • Repeated or serious policy violations.

You may stop using the Service at any time. Upon termination, your right to use the Service ends. We may delete your data after a reasonable period.

11. Warranties and liability

To the fullest extent permitted by law, the Service is provided “as is” without warranties of any kind, including merchantability or fitness for a particular purpose.

Our aggregate liability is limited to the fees you paid in the 6 months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing limits liability that cannot be limited by law.

12. Indemnity

You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

13. Changes to the Terms

We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the seller’s jurisdiction, without regard to conflict-of-law rules. Disputes will be handled by the competent courts of that jurisdiction, unless a mandatory consumer law in your country says otherwise.
